Second Offense

  • Mandatory incarceration up to one year

  • License suspension up to two years

  • Mandatory Driver Training and Alcohol Treatment

  • Fines and Costs approaching $2000.00

Third Offense

  • Mandatory minimum incarceration of one year up to five years

  • License suspension up to three years

  • Mandatory Driver Training and Alcohol Treatment

  • Fines and Costs that could exceed $5000.00

What to do if you are pulled over for a DUI

  • Refer to the officer as Sir or Ma’am

  • Be polite and cooperative with law enforcement when you are asked for your license, registration, and proof of insurance;

  • DO NOT answer any questions that the officer may ask you;

  • DO NOT submit to any sobriety test

  • DO NOT submit to any breathalyzer test

  • DO NOT consent to any search of any part of your vehicle or belongings

  • When declining to answer questions or submitting to testing, remember to be polite. Simply tell the officer that you will not submit to any testing or answer any questions without your attorney present.
